General travel and contract conditions
This translation is provided for information purposes only. In the event of any discrepancy, the French version of these terms and conditions shall prevail.
Dear Customer,
We are honoured by your interest in a trip offered by our company TMR SA or its agency TMR Voyages. We thank you for your trust and set out below our general travel and contract conditions. They apply to every type of trip sold by our company or its agency, as well as to the various means of payment in force (invoice, credit card, online payment, etc.).
1. Registration
- We advise you to register as early as possible, on a first come, first served basis.
- The contract is concluded with TMR SA or TMR Voyages upon receipt of your registration by telephone, by written booking, by e-mail or through an online purchase on our websites.
- If you hold gift vouchers, please let us know when you register.
- Once your registration has been recorded, you will receive a confirmation/booking. Please check that everything is correct (travel date, number of people, etc.).
- A deposit of 20 % of the total invoice amount is payable on this confirmation/booking; for air travel and most cruises, the deposit is 50 % (deposits are refunded in the event of cancellation).
- The balance of the invoice is payable 70, 60 or 20 days before departure, depending on the trip.
- REKA cheques are no longer accepted.
- The departure time and place, together with the number of people, are attached to the invoice.
- For air travel booked at the last minute, no booking is final without payment in advance.
2. VAT
- 8.1 % included within Swiss territory.
3. Rooms
- Accommodation is based on two people per room. Travellers wishing to stay in a single room pay a supplement. Tourist taxes are included in our prices.
4. Reductions
- Depending on the hotel, reductions for children are granted.
5. Luggage
- Luggage labels must be filled in completely, with the traveller’s surname, first name and address.
- They must be attached to the luggage.
- TMR SA and TMR Voyages accept no liability for damage to, loss of or theft of luggage.
6. Cancellation and assistance insurance (TMR SA or TMR Voyages trips*)
- This insurance is compulsory (unless you hold an ETI booklet or equivalent cover).
- Insurance that has been invoiced can no longer be cancelled.
- For all other trips (air travel, cruises, etc.), the conditions of the relevant service providers apply.
7. Cancellation by the traveller
- Cancellation of a trip by the customer must be notified to us as soon as possible.
- Such cancellation incurs charges, unless it reaches us 25 days before departure.
- If a cancellation reaches us less than 25 days before departure, the following charges will be invoiced:
- 25 to 15 days before departure: 30 % of the invoice amount + CHF 60.– administration fee.
- 14 to 10 days before departure: 50 % of the invoice amount + CHF 60.– administration fee.
- 9 to 2 days before departure: 80 % of the invoice amount + CHF 60.– administration fee.
- 1 day before departure: 100 % of the invoice amount + CHF 60.– administration fee.
- Failure to appear on the day of departure: 100 % of the invoice amount + CHF 60.– administration fee.
- Ancillary services such as shows, events and similar are invoiced in full as soon as the booking is firm.
- The insurance premium and the administration fees are always borne by the insured person. If one of the two people sharing a double room cancels, the single room supplement is borne by the remaining participant.
8. Cancellation of the trip
- If there are too few participants, the organiser reserves the right to cancel the trip no later than 20 days before departure (10 days before departure for day trips). In such cases it will notify its passengers and refund all amounts already paid in full.
9. Unused services
- If a traveller takes part in only some of the programme included in the package price, the portion corresponding to the unused services will not be refunded.
10. Insurance
- Our participants are covered by our civil liability insurance while the vehicle is in motion.
- We accept no liability outside the operation of the vehicle.
- You must carry your European Health Insurance Card.
11. Authorisation for a minor to leave the country
- It is not compulsory in order to leave Switzerland.
- It is required by the country receiving the child. You should therefore enquire with the consulate of the destination country.
12. Seats on the coach
- Seats on the coach are not reserved.
- We reserve the right to use different types of vehicle.
- Travellers on their own are kindly asked to swap window and aisle seats with their neighbour from time to time.
13. Transfers
- Transfers on the first and last day may be operated by minibus as far as the meeting point with the touring coach.
14. Programmes
- The information provided is drawn from the best sources and given in good faith.
- The organiser is not liable for material errors or for circumstances beyond its control. It declines all responsibility for information of any kind supplied by third parties for documentation purposes.
- We are in no case liable for typographical, content or printing errors.
15. Changes by the organiser
- In exceptional circumstances such as strikes, natural disasters or other disruptions beyond the agency’s control (for example an extended stay), any resulting costs are borne entirely by the customer.
- For practical or weather-related reasons, the order of the excursions may be reversed compared with the programme in the catalogue.
16. Coaches
- Our state-of-the-art vehicles are very comfortable: well-appointed interior, air conditioning, reclining and sliding seats, armrests, footrests, WC, washbasin, coffee machine, fridge, CD player, video and more.
- They are fitted with ABS, ASR and ESP safety systems (anti-lock braking, traction control, stability control) and with independent suspension for your comfort.
17. Drivers
- Our drivers are competent, experienced, helpful and friendly.
18. Identity documents
- Each participant is personally responsible for complying with the requirements relating to customs documents (identity card, passport, visa, entry permit) and for the issuing of air tickets.
- All costs and inconvenience arising from failure to comply with these requirements are borne by the participant.
- We recommend that you keep your documents with you during the trip.
- Visa applications must be submitted to the embassy responsible for the applicant’s place of residence.
- As a precaution (in the event of loss or theft), make photocopies of your identity documents.
19. Price changes
An increase in the agreed price may be justified in certain cases of force majeure, such as:
- an increase in transport costs, including the price of fuel;
- an increase in the charges and taxes relating to certain services, such as port landing fees or airport taxes;
- an increase in VAT or a change in exchange rates;
- If the increase exceeds 10 %, you will be informed 25 days before departure. You are entitled to cancel the trip by registered letter within 5 days of receiving our letter.
20. Protection of customer funds
- The company is a member of the « GARANTIE DE VOYAGE » travel guarantee fund.
21. Applicable law and place of jurisdiction
- Swiss law applies exclusively to the relationship between TMR SA or TMR Voyages and the customer.
- It is agreed that only the courts of Martigny have jurisdiction to hear claims brought against TMR SA or TMR Voyages.
- We may bring legal proceedings against the customer at their place of residence or in Martigny.
22. Miscellaneous
- Make photocopies of your medical prescriptions.
- All our coaches are non-smoking. Regular stops are scheduled.
- Animals are not accepted.
- The number of single rooms is limited.
- The photographs illustrating our travel documents are not contractually binding.
These general conditions may be amended at any time, with 21 days’ notice for trips already booked.
